Asylum decision

According to the criteria under which circumstances asylum is granted in Germany, there are 3 forms of protection, supplemented by the national prohibition of deportation.

When you apply for asylum, it is checked whether you can receive one of the 3 possible forms of protection or whether at least a national obstacle to deportation can be established.

There are therefore 4 decisions in every asylum decision. Some of these decisions are often negative.

As long as at least one decision is positive, i.e. at least one obstacle to deportation is established, your application is successful and you can stay in Germany for the time being.

You are then entitled to receive a residence permit. A residence permit is initially limited in time.

Rejection

Unfortunately, your application for asylum could not be granted if none of the forms of protection apply to your request. The negative decision also contains the expulsion order, i.e. the order to leave the country.

You may be asked to leave the country immediately. You may not have to leave Germany immediately, but will be given a tolerated stay.

This can be issued for just a few days to allow you to prepare for departure or for a much longer period.

Options after the rejection

You can appeal against the rejection decision or submit a subsequent application for asylum. If the Federal Office for Migration and Refugees (BAMF) refuses to carry out a follow-up asylum procedure, you can take legal action.

You have 2 weeks from the date of notification of the rejection decision to do so.

If you file an urgent application with the court, you cannot be deported until a decision has been made on the actual complaint.
